A Federal High Court, sitting in Abeokuta on Thursday struck out application of contempt of court order filed against Hon Oladipupo Adebutu by Senator Buruji Kashamu.
The Court ruled against the motion moved by Kashamu through his counsel, Ms Ifeoma Esom.
The counsel alleged that Adebutu was presented with flag as Ogun governorship candidate at the Lagos Presidential rally held on 12th of February, 2019.
Counsel to Adebutu, Mr. Muyiwa Obanewa, argued that his client was not presented with flag at the said rally, adding that he watched the programme live on television.
He therefore challenged that evidences be presented by the respondent, which could not be presented.
Following the arguments of both counsels on the adoption of the applicant’s application and proper hearing on the originating summons, the court adjourned till Thursday, 21st February, 2019, to properly allow Kashamu respond to the motions filed by Adebutu’s counsel.
Thursday, 14th February was initially fixed to listen to consequential amendment made to the case after the joining of Kashamu in the mandamus application filed by Adebutu on INEC compelling it (INEC) to include his name as candidate of PDP in the state.
“No matter what tactics to pervade the truth or delay, I will deliver judgement on this matter once it is heard and it will be binding”, Justice Abubakar Shittu said while reading his ruling.
