The Supreme Court of Nigeria has struck out appeals aimed at determining the authentic State Executive of the Ogun State Peoples Democractic Party (PDP) that is responsible to produce candidates for the 2019 general elections in different suits filed by both Hon Oladipupo Adebutu and Senator Buruji Kashamu.

The duo are in contention as to the rightful candidate of the PDP in the forthcoming 2019 governorship election among other elective positions in Ogun State.

Recall that Kashamu through his factional State Chairman, Bayo Dayo relying on court judgements had presented list of candidates for the general elections as against the provision of electoral act which confers only the National leadership of a political party the right to conduct primaries and field names of candidates for various elective positions.

The Supreme Court relied on the same reason for striking out both suits. The bench held that the matters were pre-election cases which ought to have been served for determination within the constitutionally provided stipulated period of fourteen days.

Meanwhile, the Federal High Court sitting in Abeokuta has adjourned till 21st of February, 2019, to determine the motion filed by the PDP to pronounce the primaries that produce Kashamu and other candidates submitted by the Senator as null and void.

The court had earlier fixed today, 11th of February, 2019 for judgement but the Counsels for the interested parties in the matter, Mrs. Funmi Odude and Mr Elias Adedokun filed separate motions to be joined in the matter.

In his argument before the court ruling, Counsel to the Plaintiff, Mr. Maliki Slyvanus representting Emeka Etiaba, SAN, argued that “the motions entered by the intervener were calculated to arrest judgement that had been reserved for today, Monday”.

After admission of the new parties to the matter, Justice Abubakar Shittu enjoined the plaintiff to serve the originating surmons on the new respondent and ruled for deposition of necessary court papers before the new date for determination.

By this ruling, the Peoples Democratic Party has a chance to replace the names of candidates which has Hon. Ladi Adebutu as its Governorship Candidate as well as other candidates to be accepted and recognized by INEC for the general elections.
