Tribunal Nullifies House Of Reps Election In Augie Council

The Kebbi National and State Assembly Election Petitions Tribunal has nullified the election of House of Representatives as it affects the Augie/Argungu Federal Constituency.

The tribunal directed INEC to conduct fresh election in the Augie Local Government Area only for the member representing Augie/Argungu Federal Constituency within 90 days, in line with paragraph 28(2) first schedule of the Electoral Act 2010 (as amended).

The nullification was sequel to the petition filed by Bashir Isa of CPC that challenged the declaration by INEC that Garba Musa of PDP as winner against the CPC candidate in the April 2011 election.

In the copy of the tribunal’s ruling signed by the Chairman, Justice Alero Edodo-Eruaga and made available to the News Agency of Nigeria (NAN) in Birnin Kebbi on Monday, the tribunal said that the petitioner (CPC) had proved that there was no valid election in Augie Local Government Area.

The tribunal held that the petitioner also proved that the election was not valid as evidenced by the certified blank forms representing the materials used for the election in Augie local council.

The tribunal nullified the election ,”on the grounds that the election was not conducted substantially in accordance with the provisions of the Electoral Act, 2010 (as amended).

“There was no substantial compliance with the Electoral Act, 2010 and that the substantial non-compliance has substantially affected the result of the election in Argungu/Augie federal constituency election. ”

The tribunal also ruled that none of the candidates in the said election could be validly returned as having won the said election in Augie Local Government Area.

It (tribunal), therefore, ruled that ” the election as it affected Augie Local Government is hereby nullified. ”

The tribunal, however, struck out the main relief of the petitioner that the CPC candidate, Bashir Isa, be declared winner of the election, saying : ” the petitioner’s case does not support it. ”
