Following the striking out of a case instituted by the Alayobo of Ayobo, Oba Idowu Ojo-Ijo against unknown persons by a Lagos High court, Lagos, South West, Nigeria for want of diligent prosecution, the Olalore Chieftancy Family who claimed to be bonafide owners of the expanse Igbo-Ilogbo land in contention, have warned against trespassers on the land.

In a public notice pasted in almost all the streets in Ayobo area of Ayobo-Ipaja Local Council Development Area of Lagos State, the Olalore family warned that the Alayobo has no right or any interest on Ayobo land, as the case he instituted claiming the ownership of the Igbo-Ilogbo land had been struck out.

Part of the notice read, “henceforth nobody should transact business, sales of land or any dealings on the Igbo-Ilogbo land with Idowu Ojo-Ijo, his family, privies and agents. All Igbo-Ilogbo land belongs to the Olalore Chieftancy family. Attached herewith is the copy of the ruling in the case.”

Oba Idowu Ojo-Ijo, on behalf of himself, members of the Alori Ataye Ewuwunmi Kadunmishe Chieftancy family and their customary tenants had gone to court challenging unknown persons for allegedly encroaching on the Igbo-Ilogbo land.

In his ruling in the suit No: ID/331M/08, Justice T.A.O Oyekan-Abdullai said order 30 rule 1 of the High Court of Lagos State (civil procedure) 2004 rules provides that “when a case on the weekly case list has been called for hearing and neither party appears, the judge shall, unless he sees good reason to the contrary, strike the case out.”

He said further that “looking at the record of the court, the parties/counsel in this suit have not appeared to prosecute their case.”
