Businessman, Hilary Unachukwu, was yesterday ordered by  a Tinubu magistrate’s court  to be remanded in prison custody.

Chief Magistrate (Mrs.) M. A. Ladipo who gave the order, adjourned till Monday, 31  January 2011 ruling on an application for bail, made by lawyer to the accused  person, Barrister Ikechukwu Iyu.

Hilary, 54, was arraigned before the court by the officer in charge of prosecution  in Lagos State, Barrister C. Agu, on a three-count criminal charge of conspiracy,  threat to life and behaving in a manner likely to cause breach of peace.

The prosecutor alleged that in the month of July, 2008, at 23A, Lugard Avenue,  Ikoyi, Lagos, Hillary conspired with others now at large, armed themselves with  machets, sticks, bottles and other dangerous weapons and threatened the life of  Chief Joe Obijaku and his family over the death of one Peter Okeke.

The offence, according to the prosecution, is punishable with terms of imprisonment  under section 517, 86(1) and 80 of the Criminal Code Cap C-17, Laws of Lagos State.

Counsel to Hilary, Barrister Ikechuwu Iyu, urged the court to grant his client bail  on liberal terms as he was a man of means, a multibillionaire and an international  businessma. He cited various authorities to the court, canvassing why his client  should be allowed to go home on bail as the offence was bailable.
