A Federal High Court sitting in Lagos has granted a garnishee order absolute attaching the accounts of Nigerian Copyright Commission with Diamond Bank Plc to satisfy the judgement sum of N4,614,492.04.
The order of the court was sequel to an application accompanied by an affidavit sworn to by Director of General Services of Fountain Source Nigeria Limited and filed before the court by Barrister Evans Azuike.
In his submission, Mr. Azuike contended that on 19 May 2010, the court awarded a total sum of N4,614,492.04 in favour of the judgement creditor against the Nigerian Copyright Commission, the judgement debtor, but the NCC has not made any effort to liquidate the judgement sum.
Consequently, the court was urged to attach the monies belonging to the Nigeria Copyright Commission in the custody of Diamond Bank to liquidate the judgement sum, as the commission has money in excess in the account to satisfy the judgement sum. The court was urged in the interest of justice to grant the application.
After listening to the submission of Mr. Azuike, the presiding judge, Justice Okon Abang, ordered that the garnishee order nisi made on 18 October, 2010 be made absolute, attaching the accounts of the Nigerian Copyright Commission with the Diamond Bank Plc.
A security company, Fountain Source Nigeria Limited sometime in 2009 dragged the Nigerian Copyright Commission before the court over a breach of contract.
The defendant entered appearance but failed to file any defence. The plaintiff then filed an application for judgement to be entered in its favour which the court acceded to.
