SOKOTO GUBER TUSSLE: WAMAKO FLOORS DINGYADI

The Supreme Court this morning in Abuja ordered for the striking out of a pending appeal filed at the Sokoto Division of the Court of Appeal by the candidate of the Democratic Peoples Party, DPP, Alhaji  Muhammed Maigari Dingyadi, challenging the return of Peoples Democratic Party’s candidate, Alhaji Aliyu Wamako as the winner of the re run gubernatorial election in Sokoto state.

The 4 man panel of the apex court led by Justice Chukwuma – Eneh, in their unanimous decision, held that the  Sokoto case was an abuse of court process as it was instituted latter than another appeal filed before the Abuja Division of the Court of Appeal by the same appellant and involving same parties over same subject matter.

Justice Chukwuma –Eneh described Dingyadi’s act of multiplicity of court action as vexatious which the court must step in the stem the drift in our legal process. According to him, “The Supreme Court is bound to intervene in the process in the interest of justice; the pending appeal in Sokoto should be dismissed as constituting an abuse of court process”

With this decision of the apex court, the much awaited delivery of the judgment of the Sokoto appeal which was expected to have sacked Wamako from the Sokoto state Government House has been arrested leaving the appeal pending before the Appeal Court in Abuja as the only issue pending for the final resolution of the gubernatorial issue in the state as fallout of the 2007 general election in the state.
