A Federal High Court sitting in Lagos has adjourned till 16 December, 2010 further hearing in a two-count charge of fraud and stealing preferred against a Lagos-based lawyer, Chief Victor Otuyemi.
The adjournment followed the absence of the accused before the court presided over by Justice Charles Effiong Archibong.
Otuyemi, who had earlier pleaded not guity to the charge, was said to have been bereaved and this made it impossible for him to appear in court.
The accused was alleged to have been involved in charges relating to advanced fee fraud amounting to N5 million.
He was alleged to have obtained the money from a businesswoman, Mrs. Titilayo Okuyiga over the property of her late father, situated at 12, Church Street, Oshodi, Lagos.
The accused was also alleged by the prosecution to have promised the complainant (Okuyiga) that he would use the money to repurchase the landed property from a family known as Oshodi Tapa Chieftaincy Family.
According to the prosecution, the offence was committed between 10 September, 2008 and 19 March, 2009 at Mafoluku, in Oshodi Local Government Area of Lagos State. The offence, the prosecution further submitted was contrary to Section 1 (1) (a) of the Advanced Fee Fraud and Other Related Offences Act, Laws of the Federation of Nigeria, 2006 and punishable under Section 3 of the same Act.
The other charge preferred against the accused alleged that he converted the sum of N5.5 million belonging to Mrs. Titilayo Okuyiga.
