Contempt: HITV Boss, Subair Apears In Court

The embattled managing director of Hitv entertainment, Toyin Subair, who was summoned by a Lagos Federal High Court, eventually appeared before the court this morning.

However, his lawyer, Dr. Joseph Nwobike (SAN) told the court that he had just been briefed and therefore, he requested for time to study the file.

Nwobike further pleaded with the court on behalf of Subair and four others who are facing contempt charge.

The presiding judge, Justice Okechukwu Okeke, said the Senior Advocate will be given time to study the file but Subair and his co-contemnor will have to answer contempt charges.

Consequently, Justice Okeke ordered that Subair and others should appear before him on 2 July to answer contempt charges.

The current contempt proceedings resulted from the disobedience of the court’s order which invited Subair and four of his staff to court over a suit filed by the Musical Copyright Society of Nigeria against Hitv, Subair and others for allegedly infringing on the musical works of some artistes in which the plaintiff has the copyright as the assignee.

Through their counsel, D.A. Awosika, they demanded N1.2 billion from the defendants as damages incurred when Hitv infringed on the works of artistes such as King Sunny Ade, Wumi Obe, Lagbaja and Adewale Ayuba on their cable channels.

Following the application, the court ordered that the court police should move into Hitv offices in Ebute Metta and Isaac John Street, GRA, Ikeja, where the copies of the infringed copyright materials are kept.

However, in an affidavit deposed to by the court bailiffs, they said when they got to the offices of Hitv, its officials maltreated them and instructed the workers not to obey the court’s order.
