The National Assembly election petition tribunal Makurdi on Thursday upheld the election of former Senate President, Senator David Mark of the Peoples Democratic Party, PDP.

In its ruling, the tribunal struck out the petition filed by the candidate of the All Progressives Party, APC, Mr Daniel Onjeh in the Benue South senatorial district poll.

Senator David Mark had asked the tribunal to dismiss Mr. Onjeh’s petition for filing outside the 21 days required by law.

The judge, while delivering his judgment on preliminary objection, ruled that the petitioner, Onjeh, filed his petition out of time and accordingly, it was thrown out.

Meanwhile, the APC candidate says he will appeal the judgment.
