Five remanded for murder, rape, armed robbery

The High Court Ikorodu, Lagos State, presided over by Honorable Justice M. A. Savage has remanded five suspects, Olufunmilayo Sanyaolu, Wasiu Shitta alias prince Shitta, Akeem Idowu Tijani, Rasheed Alegunleye and Prince Kamoru Alegunleye, in police custody pending a verdict.

The suspects will be remanded in police custody till February 15 when the court will decide on whether or not to grant them bail.

The five suspects were ordered to be detained in police custody after they pleaded not guilty to a four count charge of conspiracy to commit felony, murder, rape and armed robbery.

In the charge informed by the Inspector General of Police of the Federal Rebuplic of Nigeria pursuant to sections 72 and 337 of the Criminal Procedure Act , and section 105(c) of the Administration of Criminal Justice Act, 2015 Laws of the Federation of Nigeria that you Olufunmilayo Sanyaolu, Wasiu Shitta, Akeem Idowu Tijani, Alegunleye Rasheed, Kamoru Alegunleye and others still at large, on the 17th day of February, 2015 at Lugbusi/ Agunfoye villages, via, Adano, Ikorodu within the Jurisdiction of this Honourable court did conspire to commit felony to wit: murder contrary to section 324 of the Criminal Code Act, CAP. C. Laws of the Federation of Nigeria, 2004, as applicable to Lagos state.

That you Olufunmilayo Sanyaolu, Wasiu Shitta, Akeem Idowu Tijani, Alegunleye Rasheed, Kamoru Alegunleye and others still at large, on the 17th day of February, 2015 at Lugbusi/ Agunfoye villages, via, Adano, Ikorodu within the Jurisdiction of this Honourable court did with intent to kill or cause grievous harm, murdered Bamidele Oluwole and thereby committed an offence contrary to Section 319 (1) of the Criminal Code Act, CAP. C. Laws of the Federation of Nigeria, 2004, as applicable to Lagos state.

That you Akeem Idowu Tijani on 27 February, 2015 in Agunfoye villages, via, Adano, Ikorodu within the Jurisdiction of this Honourable court along with Ishola Sheidu, Wasiu Kehinde alias Jebba now at large around 4:00pm raped Mrs. Idowu Asikoloye therefore committed an offence contrary to section 358 of the Criminal Code Act, CAP. C.38 Laws of the Federation of Nigeria, 2004, as applicable to Lagos state.

That you Akeem Idowu Tijani on 27 February, 2015 Agunfoye villages, via, Adano, Ikorodu within the Jurisdiction of this Honourable court along with Ishola Sheidu, Wasiu Kehinde alias Jebba now at large around 4:00pm robbed Mrs. Idowu Asikoloye of the sum of three hundred thousand naira (₦300,000) and immediately after the robbery, you and your gang were armed with offensive weapons with which you shot sporadically and thereby committed an act contrary to section 1(2) (a) and (b) of the robbery and firearms (Special Provisions) Act, CAP R. 11, Laws of the Federation of Nigeria, 2004.

When the matter came up, Barrister David Abuo moved the count to grant leave so that the accused can take their plea but the counsel to the accused persons objected that the accused persons should have been charged to the Federal High Court.

In reply, counsel to the prosecution stated that the offence with which the accused persons where charged are triable by the Lagos state High Court and urged the court to dismiss the objection, an advocate the judge consented to by reserving the ruling, while the suspects remain in police custody, till February 15, 2016.
